1. Agreement to Terms

By accessing or using TruckSense AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

TruckSense AI is operated by TruckSense AI Ltd (Company Number: 16938163), a company registered in England and Wales ("we", "us", "our").

2. Description of Service

TruckSense AI is a subscription-based diagnostic support tool for forklift and material handling equipment engineers. The Service provides:

• AI-powered diagnostic guidance and troubleshooting assistance
• Technical information across multiple manufacturers
• Job tracking and documentation tools
• Engineer wellbeing features including a personal journal

3. Subscription and Payment

• Subscription cost: £10 per month (or as displayed at checkout)
• Payments are processed securely via Stripe
• Subscriptions automatically renew monthly unless cancelled
• You may cancel your subscription at any time via your account settings
• No refunds are provided for partial months
• We reserve the right to change pricing with 30 days notice to existing subscribers

4. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorised access
• Providing accurate registration information

5. Acceptable Use

You agree NOT to:

• Share your account credentials with others
• Use the Service for any illegal purpose
• Attempt to reverse engineer, copy, or extract our software or AI systems
• Input false, misleading, or malicious information
• Violate any applicable laws or regulations
• Use the Service in any way that could damage, disable, or impair it
• Attempt to gain unauthorised access to any part of the Service

6. Intellectual Property

All content, features, functionality, software, and diagnostic methodologies of TruckSense AI are the exclusive intellectual property of TruckSense AI Ltd and are protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, reproduce, or distribute our content
• Create derivative works based on the Service
• Use our trademarks, branding, or logos without written permission
• Screen capture or record Service content for redistribution

7. User Content

Content you create within the Service (job notes, journal entries, uploaded images, etc.):

• Remains your property
• Is stored securely and privately
• Will not be shared with third parties except as required by law
• You grant us a licence to store and process it solely to provide the Service

8. Limitation of Liability

TruckSense AI Ltd and its directors are not liable for:

• Any damages arising from your use of the Service
• Injuries, property damage, or losses resulting from following any guidance provided
• Inaccuracies, errors, or omissions in information provided
• Service interruptions, downtime, or data loss
• Any indirect, incidental, consequential, or punitive damages
• Loss of profits, revenue, or business opportunities

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

You use the Service entirely at your own risk.

9. Indemnification

You agree to indemnify, defend, and hold harmless TruckSense AI Ltd, its directors, employees, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any work you perform based on Service guidance
• Any claims made by third parties relating to your use of the Service

10. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may:

• Perform scheduled maintenance that temporarily limits access
• Modify, update, or discontinue features with reasonable notice
• Suspend access for non-payment or Terms violations
• Experience unplanned outages due to circumstances beyond our control

11. Termination

We may terminate or suspend your account immediately, without prior notice, if you:

• Violate these Terms
• Fail to pay subscription fees when due
• Use the Service inappropriately, fraudulently, or illegally
• Engage in any activity that harms the Service or other users

Upon termination:

• Your access ends immediately
• No refunds are provided for unused subscription time
• You may request export of your data within 30 days

12. Changes to Terms

We may update these Terms at any time. Changes will be posted in the app and on our website. Continued use of the Service after changes constitutes your acceptance of the updated Terms.

For material changes, we will provide at least 30 days notice via email to your registered address.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TruckSense AI Ltd regarding the use of the Service, superseding any prior agreements.
